Although MiWay will not be able to assist you with a claim for the damages to your vehicle or against the third party, due to the fact that the premiums for the relevant month were not received, we do understand the predicament you find yourself in. We would however like to suggest that you seek the assistance of the SAPS to attempt to trace the owner of the third party vehicle. Once the owner’s identity is established you may proceed with a third party claim against the other party if in fact they were the cause of the incident. You can submit a third party claim against the third party’s insurer if that person is insured. Should the insurer however refute liability, you may proceed with a delictual claim for damages against the driver of the third party vehicle.
