What happens in the case where someone hits another car while they have been drinking and driving? Does the other person go to their own insurance company? Does third party pay for the other persons car? Please advise.

If you have insured your vehicle through MiWay and are involved in an accident where the driver of your vehicle was under the influence of alcohol or drugs or has a concentration of alcohol in the blood exceeding the legal limit; or fails a breathalyser test; or refuses to give either a breath or blood sample the claim will be rejected as these are exclusions under our policy.

The other person who suffered damages should claim from their own insurer (providing they have insurance) who will entertain their claim and then institute a recovery on their behalf. The recovery will be against the person in their personal capacity if the claim was rejected by the insurer of the person who was driving under the influence.

The RAF only covers bodily injuries not material damages therefore the damages to the other party’s vehicle will not be covered by “third part” as referred to in your question.
