By accessing this site the user is bound to the version of the terms and conditions published at the time of any visits to MiWay makes no commitment to update the materials and may discontinue any part of the MiWay website or services or certain software or version of certain software for the utilisation of the MiWay website.
Applicable and governing law
The law of the Republic of South Africa shall govern this agreement and all parties to this message consent to the jurisdiction of the Witwatersrand, Magistrates – and/or High Court, Johannesburg.
Privacy and security policy
MiWay values the importance of protecting the user’s personal information and as such subscribes to the principles, outlined in Section 51 of the Electronic Communications and Transactions Act 2002. This act governs the individual’s right to having their personal information kept private.
Personal information for the purpose of this document means all information specific to the user that is provided to MiWay via the internet or any other channel. This includes personal data that the user provides MiWay to obtain an online quotation, personal policy data that the user may want to view and or amend or questions asked by the user via e-mail.
MiWay value the information the user chose to provide and will take reasonable steps to protect the personal information from loss, misuse or unauthorized alteration. The information MiWay maintain of their customers is stored in databases that have built-in safeguards to ensure the privacy and confidentiality of that information. State of the art technology and encryption are used to prevent any unauthorized access to personal information when registering and transacting on the MiWay website.
MiWay however cannot guarantee the security of any data the user discloses online. The user accepts the inherent risks of providing information and dealing online over the Internet and will not hold MiWay, its directors, employees or agents responsible for any breach of security unless this is due to MiWay’s gross negligence or wilful misconduct.
The use of the on-line services provided by us, access to personal information or to transact on-line would require an access number, user name and password to validate your identification and enable access to MiWay’s secure environment. The user must always keep this information secret and ensures that it is not disclosed to anyone. To ensure continuance in preventing unauthorized access to information MiWay recommends that the user change his/her password on a monthly basis or immediately should the password be compromised in any way.
MiWay has the highest regard for the privacy of its customers and will use personal information only as appropriate in the normal course of business to provide the products and services requested. MiWay will also use the information to positively identify the user when same contact MiWay on-line.
MiWay does not permit the selling or providing of personal information to third parties for independent use. MiWay may however share information with their business partners if that information is required to provide the product or service requested by the user. Our business partners will adhere to using such information only as directed by MiWay.
The user has a right to see its own personal information that MiWay keeps about the user by following the procedures available under the MiWay Section 51 Manual on the Promotion of Access to Information Act, available from the MiWay website, subject to the fees applicable. The user must contact MiWay if he/she is concerned that any of the information MiWay holds on him/her is incorrect.
