MiWay App Terms of Use

  • MiWay Insurance Limited is a company registered in terms of the laws of the republic of South Africa, with registration number 2007/026289/06, a licensed non-life insurer and financial services provider (FSP No. 33970) hereinafter referred to as (“MiWay”).
  • Please read these Terms and Conditions carefully as they apply to your use of this App. If you do not accept the terms and conditions outlined, please do not continue to use this App.
  • MiWay may revise these Terms and Conditions at any time by updating this page without any prior notice. You are advised to review this page periodically, as these terms and conditions are binding upon you.
  • General terms of use:
    • In order to use the App, you must register a profile. Use of the App includes, but is not limited to, requesting and completing a quotation and accepting a quotation and therefore entering into an Insurance Policy with MiWay.
    • You acknowledge and accept that you must provide true and complete information on the App at all times. Should any information change, you will update the App.
    • In the event that you have a Policy with MiWay, the current status of your cover is reflected in the App and on your Coversheet (policy schedule), a copy of which is also stored in the App. By using this App, you consent to receiving important information, documentation and correspondence electronically.
    • If there is any conflict between the Coversheet, FAIS Disclosure Notice or Policy Wording (“policy documents”) and these Terms of Use, the policy documents will prevail.
    • When using MiWay’s App, always keep your login details safe and confidential. This will ensure that nobody can access your information without the necessary authorisation to do so.
    • All information is viewed, downloaded or printed for personal use only.
    • All copyright and intellectual property rights to all content on this App is owned by and vests in MiWay – including logos, other graphics and multimedia elements. If you would like to use any information from this App, you must credit MiWay clearly.
    • Never use any of MiWay’s trademarks without MiWay’s prior written consent. This includes linking to this App in any way. If you do this without MiWay’s prior written consent, MiWay is entitled to take legal action and any legal costs will be for your account.
    • Any email address, name, telephone number, WhatsApp number or fax number on this App IS NOT to be used for electronic marketing or database building purposes. The fact that we display this information does not imply that we consent to the use of this information for database building purposes.
    • Any information, document or other material made available by this App is without any warranty of any kind, either express or implied, including, but not limited to the warranties of completeness, accuracy, fitness or non-infringement.
    • MiWay disclaims any liability and is not liable to any user for any direct, indirect or consequential damages caused by the errors or omissions, whether negligent or otherwise, in any information, document or other material provided or available within this App.
    • MiWay will not charge you a fee for the use of this App. You may be charged data fees by your mobile service provider to access this App and to use any of its functionality.
    • This App, its content, these terms of use and MiWay’s business shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
    • Should it, in MiWay’s sole discretion, be found that you have used the App for any unauthorised and/or illegal purposes, your use of the App will be terminated immediately and MiWay may exhaust all legal remedies available to it and you will be held liable for all costs incurred by MiWay.
  • Application Rights
    • This App may only be used on devices owned or controlled by the user using Android or Apple operating systems. Certain devices may be incompatible with particular features in the App. In the event that your device is incompatible, you will be notified in the App when attempting to access such feature. Should you have any questions in this regard, please contact us on miwayapp@miway.co.za.
    • You acknowledge that the operating system has no obligation to provide any support or maintenance services in relation to the operating system application.
    • You will be required to update the App as and when prompted to do so in order to fully access the products and services which are available on the App.
  • MiWay cannot promise or guarantee:
    • That this App will be available and functional 100% of the time.
    • That all downloads from this App will always be free of viruses and will not damage your phone or data on it.
    • The nature, content and availability of the third-party links. MiWay also cannot control or guarantee the accuracy or quality of the information, material and graphics from these links. The inclusion of any such links does not necessarily imply a recommendation or endorsement of the views expressed within them. If you come across any external links that do not work, please report them to miwayapp@miway.co.za.
    • The security of any data you supply MiWay with on the App is subject to minimum security levels as may be prescribed by applicable laws. For practical business reasons and because the law might require it, we need to store some of your information in our databases. Although we have built-in safeguards to ensure security, privacy and confidentiality of that information, this is entirely at your own risk.
  • Availability and Termination:
    • MiWay may in its sole discretion and at any time, for any reason and without prior notice, suspend or terminate the operation of the App (in whole or in part) or your right to access or use the App, including, but not limited to, for scheduled and unscheduled maintenance of the App; which may impact the availability and functionality of the App, and therefore the products and services, but not the validity of a Policy purchased prior to such suspension or termination. If you breach any of these Terms of Use or other policies to which you agree, we may terminate your access and use of the MiWay App with immediate effect.

  • Promotions:
    • All promotions by MiWay Blink (a division of MiWay Insurance Limited) will not be applicable to policies underwritten through the MiWay App, website or any other medium, unless it is specifically specified in the promotion that it is applicable to policies underwritten through the MiWay App, website or any other medium.
  • Emergency Alert:
    • If you are eligible for Emergency Alert, you must opt-in on the App to make use of this Feature.
    • You must read these Terms of Use, the FAQs on the App and your Policy Documents for the terms and conditions when using the Emergency Alert feature.
    • The App uses certain phone sensors to detect if the vehicle has been in an accident. Based on the information received by the App from your phone’s sensors, the App can determine how serious the accident was. If, in MiWay’s sole discretion, the collision is classified as serious, it will trigger an alert for the MiWay Emergency Assistance team (MiHelp) to respond accordingly.
    • Your phone must have data available and network connectivity at the time of the accident for the Emergency Alert feature to trigger an alert.
    • It is important to note that:
      • Accidents which occur while a vehicle is stationary or at speeds below 16km/h, will not be detected by the MiWay App.
      • Certain light impacts that don't exceed the g-force thresholds, will not be detected by the MiWay App.

    • We obtain and maintain information about you in various ways.
    • What information do we collect?
      • Information you provide directly:
        • Personal information submitted by you on the App, such as name, surname, identity number, cell-phone number, email address, registration number and/or VIN number.
      • Information about your use of the App:
        • In the event that you have opted into the telematics features on the App, which includes crash detection (Emergency Alert), you will be required to allow permissions on the App for us to track driving information which includes location services, activity recognition on Android or Motion and Fitness on iOS, and Bluetooth (whenever applicable), in order for you to receive or use the services on the App. We will be able to track your exact geolocation once you have allowed permissions on the App. If you decline permissions on the App, you will not be able to benefit from the MiWay product features which rely on telematics data and MiWay would not be able to detect when you were in a car accident.
        • In-App usage information, including, chats, menus and settings clicked, features used, frequency and duration of use of the App, and severe impact report data. We use features such as Google Analytics to track this.
        • Device information, such as firmware version, operating system and device identifiers.
        • MiWay makes use of cookies in order to evaluate and enhance the product and services offered on the App. Cookies are text files containing small amounts of information, which your computer or mobile device downloads when you visit the App. Cookies help us to understand how the App is used, let you navigate between pages and generally improve your browsing experience. By continuing your visit to our App, you consent to the use of cookies. There are various ways to block cookies or to opt out by using the Google Analytics opt-out browser add-on.
    • How do we use your information?
      • To provide insurance quotations and policies.
      • To mobilise emergency assistance services.
      • To monitor trips to provide the crash detection services (Emergency Alert).
      • For claim information, claims submissions and to validate claims.
      • To send you important policy information and documentation.
      • To respond to your requests, inquiries and instructions made through the App or any other communication channels.
      • To provide promotions and offers by way of direct marketing communications, only where you have given us your consent.
      • To operate, evaluate and improve our business (including developing new products; analysing, enhancing and improving our products; managing our communications; performing data analytics; and performing accounting, auditing and other internal functions).
      • To comply with and enforce applicable legal requirements, relevant industry standards and our policies.
    • Who do we share your information with?
      • We will disclose your information internally within our business and to the following entities:
        • Business Partners that we work with in order to provide you with the services noted in the App and other policy documentation.
        • Service Providers that we have selected to provide services for or on behalf of us in order for us to ensure we deliver on our obligations to you.
